UMA ANÁLISE DA SANÇÃO DE SUSPENSÃO DOS DIREITOS POLÍTICOS POR IMPROBIDADE ADMINISTRATIVA A PARTIR DAS DECISÕES DO STF ACERCA DA INTERNALIZAÇÃO DO PACTO DE SÃO JOSÉ DA COSTA RICA.

Na atual sociedade da informação, regida por políticas de acesso e de privacidade, o direito ao esquecimento surge como ferramenta de proteção dos direitos fundamentais do cidadão. Assim, discute-se algumas ambivalências que envolvem esse direito e sua efetiva sua aplicabilidade. No Brasil, não há uma legislação específica que verse sobre a aplicação do direito ao esquecimento e sua relação com a memória individual e coletiva, sendo realizados julgamentos com base na ponderação de direitos fundamentais oriundos da personalidade humana. Além disso, (...) Supremo Tribunal Federal considerou que o direito ao esquecimento é incompatível com a Constituição Federal, apontando para as análises de casos concretos que comentam excessos e abusos à liberdade de expressão e ao direito à informação. Considera, contudo, que o movimento de proteção de dados resultou em instrumentos normativos para atender às demandas sociais, políticas e econômicas do mundo contemporâneo, sobretudo, na produção dos direitos de personalidade. This article looks at the complexity of the thought processes that lead Seneca's Oedipus to choose the mors longa of blindness as punishment for his crime. It offers an analysis of the consolation of this existence on the threshold between life and death, notably with reference to the end of the Oedipus, but also of the sorrow of this liminal existence. The latter is described in Seneca's Phoenissae, which suggests an escape, by death stricto sensu, from the threshold represented by (...) blindness, by which Oedipus now feels trapped.By examining these three topics, the article shows how the threshold between life and death which Oedipus chooses at the end of Seneca's Oedipus and experiences in the Phoenissae mirrors the ambivalence and the errors of his life before he blinded himself. Ultimately, it also illustrates Oedipus’ continuing failure to achieve self-knowledge. (shrink)

O desenvolvimento tecnológico promoveu o aumento de produção e compartilhamento de conteúdo em plataformas digitais, sendo difícil gerenciar o acesso adequado a informações. O presente artigo tem como objetivo discutir os efeitos do direito ao esquecimento no ambiente digital, considerando o processo de desindexação como estratégia para operacionalizar a efetividade desse direito. Tomando como referências arcabouços teóricos-conceituais acerca da complexidade compósita da informação e de antinomias entre a dignidade da pessoa humana e a liberdade de expressão e o direito à (...) informação, oriundos, respectivamente, da Ciência da Informação e do Direito, analisam-se e discutem-se algumas decisões jurisprudenciais e posicionamentos doutrinários no cenário brasileiro. O direito ao esquecimento está cercado de ambivalências e desafios de ordens normativa, tecnológica e cultural, num compartilhamento de informações em níveis sem precedentes que interferem negativamente na sua efetivação no ambiente digital. A predominância dos temas literários e fenomenológicos nos textos sartrianos dos anos 1930 já chamou atenção de vários especialistas e comentadores da obra do autor. É notável, entretanto, como os exames dos textos dessa época contentam-se, no mais das vezes, em apontar o paralelismo ou a contemporaneidade entre fenomenologia e literatura ali presente, sem realçar a fundamentação que uma parece conferir à outra e que constitui uma das questões mais interessantes que a filosofia sartriana levanta. Há que se incluir, na (...) verdade, a estética literária de Sartre na compreensão de suas teses fenomenológicas; teses estas que, por outro lado, fornecem o solo filosófico da literatura sartriana, em termos tanto de autoria quanto de crítica. O propósito deste artigo é demonstrar, assim, uma dependência ou, se quisermos, implicação mútua entre literatura e fenomenologia não apenas central em relação àquele período da produção de Sartre como, também, determinante para seus projetos teóricos e ficcionais ulteriores. The neural correlates of software programming skills have been the target of an increasing number of studies in the past few years. Those studies focused on error-monitoring during software code inspection. Others have studied task-related cognitive load as measured by distinct neurophysiological measures. Most studies addressed only syntax errors. However, a recent functional MRI study suggested a pivotal role of the insula during error-monitoring when challenging deep-level analysis of code inspection was required. This raised the hypothesis that the insula is (...) causally involved in deep error-monitoring. To confirm this hypothesis, we carried out a new fMRI study where participants performed a deep source-code comprehension task that included error-monitoring to detect bugs in the code. The generality of our paradigm was enhanced by comparison with a variety of tasks related to text reading and bugless source-code understanding. Healthy adult programmers participated in this 3T fMRI experiment. The activation maps evoked by error-related events confirmed significant activations in the insula [p < 0.05]. Importantly, a posterior-to-anterior causality shift was observed concerning the role of the insula: in the absence of error, causal directions were mainly bottom-up, whereas, in their presence, the strong causal top-down effects from frontal regions, in particular, the anterior cingulate cortex was observed. O presente texto narra uma experiência de formação de alfabetizadores de jovens e adultos: uma alfabetização filosófica de 40 horas com 300 alfabetizadores em julho de 2022, como primeira etapa do Programa “Supera RN” em Pau dos Ferros, dentro da Política de Superação do Analfabetismo do Estado do Rio Grande do Norte (RN). O texto tematiza em que sentido a experiência de Alfabetização filosófica se inspira e ao mesmo tempo se diferencia do curso de Alfabetização oferecido por Paulo Freire em (...) Angicos em 1963. Inspirado na curiosidade e no compromisso de Paulo Freire com os esfarrapados do mundo, o conceito “alfabetização filosófica” propõe uma formação experiencial sustentada nas seguintes disposições: escutar atentamente o mundo humano e não humano que nos rodeia; pensar juntos com cuidado e calma; relacionarmo-nos cooperativa e não competitivamente com as ideias das outras pessoas; perguntarmo-nos, colocando em questão, nossa vida e a maneira como nos relacionamos com ela, num tempo especial, singular, suspendido; conversar como iguais na busca de enfrentar as exigências de nossa comunidade; inventar novas formas de estar com outras e outros. O texto apresenta como essas disposições foram pensadas e praticadas durante a alfabetização filosófica em Pau dos Ferros, RN, através de cinco princípios (perguntar; escutar; tempo de infância; igualdade; pensar juntos) e lança algumas perguntas sobre possíveis desdobramentos da alfabetização filosófica no campo de formação de professores. His principal work is the one which establishes that the labor theory of value holds not only in the state of nature, as for Locke, nor only in primitive society, as for Adam Smith, but also in the highest civilized society and, as against Ricardo, in such a way as to prove (...) that the proletariat is and must be exploited but will and can never exploit. With the analysis and reduction of capital into labor, the possibility of freedom in this new meaning, which is merely asserted in the "humanism" of his earlier writings, is proven and secured with the necessity of science. The philosophy of medicine cum bioethics has become the socially recognized source for moral and epistemic direction in health-care decision-making. Over the last three decades, this field has been accepted politically as an authorized source of guidance for policy and law. The field's political actors have included the National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research, the Department of Health, Education, and Welfare, the President's Commission for the Study of Ethical Problems in Medicine and Biomedical (...) and Behavioral Research, the National Bioethics Advisory Commission, and the new Council on Bioethics; these groups and agencies have set forth rules on issues ranging from the role of humans in biomedical research to the production of human embryos for research, the definition of death, and the permissibility of human cloning. The members of the field are not just scholars and teachers in an academic realm directed to both theoretical and applied issues. They are, in addition, practitioners of a conceptual and moral trade that possesses a legal and political standing. This essay critically addresses the sudden emergence of bioethics as a societally recognized source of moral guidance, a source replete with authorized moral experts. Attention is directed to moral and conceptual assumptions that have led the philosophy of medicine, and especially bioethics, to acquire a quasi-juridical/political role in guiding clinical choices, framing health-care policy, and directing court holdings. Inspired by the early Wittgenstein’s concept of nonsense (meaning that which lies beyond the limits of language), we define two different, yet complementary, types of nonsense: formal nonsense and pragmatic nonsense. The simpler notion of formal nonsense is initially defined within Tarski’s semantic theory of truth; the notion of pragmatic nonsense, by its turn, is formulated within the context of the theory of pragmatic truth, also known as quasi-truth, as formalized by da Costa and his collaborators. While an expression will (...) be considered formally nonsensical if the formal criteria required for the assignment of any truth-value (whether true, false, pragmatically true, or pragmatically false) to such sentence are not met, a (well-formed) formula will be considered pragmatically nonsensical if the pragmatic criteria (inscribed within the context of scientific practice) required for the assignment of any truth-value to such sentence are not met. Thus, in the context of the theory of pragmatic truth, any (well-formed) formula of a formal language interpreted on a simple pragmatic structure will be considered pragmatically nonsensical if the set of primary sentences of such structure is not well-built, that is, if it does not include the relevant observational data and/or theoretical results, or if it does include sentences that are inconsistent with such data. We can communicate linguistic information by asserting sentences that are not explicitly about linguistic matters. Stalnaker offers a pragmatic account of this phenomenon. It is not clear that such an account is correct. In this article I offer an alternative account that does not rely on pragmatic mechanisms and which captures many of the insights in Stalnaker's theory of linguistic communication. The view is inspired by Barker's semantics of vague adjectives.

Interpreting Figurative Meaning critically evaluates the recent empirical work from psycholinguistics and neuroscience examining the successes and difficulties associated with interpreting figurative language. There is now a huge, often contradictory literature on how people understand figures of speech. Gibbs and Colston argue that there may not be a single theory or model that adequately explains both the processes and products of figurative meaning experience. Experimental research may ultimately be unable to simply adjudicate between current models in psychology, linguistics and philosophy (...) of how figurative meaning is interpreted. Alternatively, the authors advance a broad theoretical framework, motivated by ideas from 'dynamical systems theory', that describes the multiple, interacting influences which shape people's experiences of figurative meaning in discourse. This book details past research and theory, offers a critical assessment of this work and sets the stage for a new vision of figurative experience in human life. (shrink)

In Sein und Zeit, Heidegger claims that (1) das Man is an 'existential' i.e. a necessary feature of Dasein's Being; and (2) Dasein need not always exist in the mode of the Man-self, but can also be eigentlich, which I translate as 'self-owningly'. These apparently contradictory statements have prompted a debate between Hubert Dreyfus, who recommends abandoning (2), and Frederick Olafson, who favors jettisoning (1). I offer an interpretation of the structure of Dasein's Being compatible with both (1) and (2), (...) thus resolving the Dreyfus-Olafson debate. Central to this resolution is the distinction between das Man and the Man-self. Das Man is one of three existential 'horizons', or fields of possibilities; the other two horizons are the world and death. At any time, Dasein encounters entities in one of two basic modes: either by 'expressly seizing' possibilities of the horizon, or by occluding these possibilities. These modes are 'existentiell', i.e. features of Dasein's Being that are possible, but not essential. Self-ownership and the Man-self are the two basic existentiell modes of being oneself, i.e. projecting everyday possibilities of oneself appropriated from the horizon of das Man. What differentiates these two modes is the stance one takes to the possibility of death, the existential horizon of being oneself. (shrink)

Sexting has been defined as sending, receiving, or forwarding sexually explicit messages, images, or photos to others through digital platforms, and can assume more consensual or more abusive and violent forms. This study aims to explore the prevalence of abusive sexting in Portuguese adolescents and the psychological characteristics of sexting abusers in terms of emotional and behavioral problems, potential markers of psychopathy, childhood trauma and maltreatment, and different forms of aggression. A cross-sectional study was conducted with 4,281 participants, aged 12–20 (...) years, of whom 204 engaged in abusive sexting behaviors and 182 self-identified as being a non-consensual sexting victim. Abusive sexting was more common among boys and middle adolescents, and abusive sexting victims were more likely to be children of single-parent families. Engaging in abusive sexting and being a victim of abusive sexting were also related to behavioral and emotional problems, callousness, experiences of neglect and abuse in childhood, and various forms of aggression. Implications for future research and intervention are discussed. (shrink)

Este artículo muestra varios detalles para entender la compleja figura de Ariadna en el pensamiento de Nietzsche, pero que va más allá del autor alemán y se sumerge en ciertos momentos de Ariadna, desde lo etimológico a Otto pasando por Ovidio y Catulo, para dar cuenta de una Ariadna que es la compañera del dios Diónysos y que en cierta forma posibilita la propia verdad del dios; lo que Nietzsche llamaría “eterno retorno”.

This article reflects on how the issue of the Real allows us to rethink the human of today in a more complete and up-to-date way. And for this purpose, two apparently dissimilar perspectives of understanding the Real are discussed: that of the Slovenian philosopher Slavoj Žižek, which is rooted in Lacan’s psychoanalysis, and that of the Spanish philosopher Xavier Zubiri, which is born from a deep critical dialogue with Heidegger’s ontology. This paper will show the unity of two visions of (...) the Real that lie at the heart of what is human and that allow us to criticize certain very influential psychoanalytic thought, centred on Jacques-Alain Miller, which cannot account for what is happening to us radically in the current era, or, perhaps, in any era. Neste artigo mostra-se os resultados de uma busca em bases de dados internacionais sobre a teoria do agir comunicativo de Habermas na área da Administração de Organizações. A teoria de Habermas foi desenvolvida após a sua guinada linguística, de ruptura com a filosofia da consciência e a metafísica em 1981. Nela os usos da linguagem são modos de expressão e representação, mas também modo de construção de vínculos sociais. A partir desta teoria, Habermas desenvolve a ideia de discurso como agir (...) comunicativo orientado para o entendimento, e elabora uma ética do discurso e uma política deliberativa. A entrada da obra de Habermas na Administração antecede a sua guinada linguística, e deve ser destacado o uso da sua tese "Mudança estrutural da esfera pública". Neste artigo quer-se destacar as relações estabelecidas entre a filosofia da linguagem e a Administração, tanto em acordos teóricos quanto práticos. Entre os aspectos teóricos destaca-se os estudos teóricos do conhecimento, incluindo a epistemologia. Entre os aspectos práticos estão as questões da filosofia prática, a ética e a política. Quer-se assim apresentar o potencial da filosofia de Habermas para pesquisa e trabalho na Administração de Organizações. (shrink)

The semantic paradoxes are a family of arguments – including the liar paradox, Curry’s paradox, Grelling’s paradox of heterologicality, Richard’s and Berry’s paradoxes of definability, and others – which have two things in common: first, they make an essential use of such semantic concepts as those of truth, satisfaction, reference, definition, etc.; second, they seem to be very good arguments until we see that their conclusions are contradictory or absurd. These arguments raise serious doubts concerning the coherence of the concepts (...) involved. This article will offer an introduction to some of the main theories that have been proposed to solve the paradoxes and avert those doubts. Included is also a brief history of the semantic paradoxes from Eubulides to Tarski and Curry. (shrink)

It may be commonplace hearing people accuse the discipline of philosophy of irrelevance, especially when it comes to societal issues. Hannah Arendt, a contemporary political thinker, remarked that philosophy and political action are irreconcilable spheres of thought—that the space for contemplation is nowhere near the space for action. Granting Arendt’s observation, how can philosophy courses cross the chasm brought about by disciplinal borders? How can philosophy classes help produce active and more engaged citizens? In this paper, I dispute the former (...) claim by way of undertaking two tasks. First, to lay down the groundwork, I provide a philosophical analysis that underlines Hannah Arendt’s political position and most important ideas, particularly those that surface in one of her greatest works, “The Human Condition.” Second, I point out how Arendt’s notions inspire some practices in education and pedagogy, thus paving the way for a genuine application of a philosophical theory to society. By drawing on experiences in teaching philosophy by employing social reconstructionist education and its corollary pedagogical tool, service-learning, this paper hopes to bring back some space to a reconsideration of philosophy as a relevant discipline in society, particularly in education. In the end, I conclude that philosophy and action, contrary to the claim of Arendt herself, are fully compatible. In doing philosophy, the germ of genuine action may be found. (shrink)
